Bảng chi tiết Phụ lục II Danh mục hóa chất sản xuất kinh doanh có điều kiện
Phụ lục II – Danh mục hóa chất sản xuất, kinh doanh có điều kiện – liệt kê khoảng 786 chất và hỗn hợp chất, được chia thành hai nhóm:
- Chất sản xuất, kinh doanh có điều kiện: là các chất nguy hiểm được nêu tên, mã số cụ thể trong Phụ lục II.
- Hỗn hợp chất sản xuất, kinh doanh có điều kiện: là hỗn hợp chất chứa ít nhất một thành phần thuộc Danh mục nêu trên với hàm lượng lớn hơn 5% khối lượng.
Danh mục hóa chất là căn cứ để xác định một hóa chất cụ thể có thuộc diện “hóa chất có điều kiện” hay không, từ đó xác định tổ chức có bắt buộc phải xin Giấy chứng nhận đủ điều kiện kinh doanh hóa chất có điều kiện trước khi hoạt động hay không.

Hỗn hợp chất sản xuất, kinh doanh có điều kiện
Hỗn hợp chất sản xuất, kinh doanh có điều kiện là hỗn hợp chất chứa ít nhất một thành phần trong Danh mục hóa chất sản xuất, kinh doanh có điều kiện của Nghị định này có hàm lượng lớn hơn 5% khối lượng.
Cách tra cứu, xác định hóa chất thuộc danh mục có điều kiện hay không

Để xác định hóa chất, sản phẩm của mình có thuộc Danh mục hóa chất sản xuất, kinh doanh có điều kiện hay không, doanh nghiệp nên thực hiện theo các bước sau:
- Đối chiếu tên hóa chất và mã số CAS của chất mình sản xuất, kinh doanh với danh sách chất tại Phụ lục II Nghị định 24/2026/NĐ-CP. (Tra cứu trực tiếp trong bài viết bằng cách nhấn tổ hợp phím Ctrl + F sau đó gõ tên hóa chất trên công cụ tìm kiếm và đối chiếu)
- Nếu sản phẩm là hỗn hợp chất, xác định các thành phần cấu thành và tính tỷ lệ phần trăm khối lượng của từng thành phần; nếu có thành phần thuộc Danh mục chất với hàm lượng trên 5%, sản phẩm được coi là hỗn hợp chất sản xuất, kinh doanh có điều kiện.
- Tham chiếu thêm Phiếu an toàn hóa chất (SDS) của sản phẩm để xác định chính xác thành phần và hàm lượng.
- Nếu hóa chất đồng thời thuộc Phụ lục III Danh mục hóa chất cần kiểm soát đặc biệt, doanh nghiệp cần lưu ý nghĩa vụ xin phép sẽ nghiêm ngặt hơn.
Việc xác định chính xác một hóa chất, sản phẩm có thuộc Danh mục hóa chất sản xuất, kinh doanh có điều kiện hay không là bước đầu tiên và quan trọng nhất trước khi doanh nghiệp quyết định đầu tư vào lĩnh vực này, bởi nếu bỏ sót, doanh nghiệp có thể vô tình hoạt động không phép, dẫn đến rủi ro bị xử phạt hành chính, đình chỉ hoạt động, thậm chí truy cứu trách nhiệm hình sự trong trường hợp gây hậu quả nghiêm trọng.
